The trial court stated that “[t]he law does not impose immediate and unconditional liability upon a landlord for violating a warranty of habitability. The landlord is liable only if repairs are not effected after actual or constructive notice of the defective reaches the landlord. What is a reasonable time for the landlord to correct a condition is a question of fact for you to decide. You should consider the evidence which you believe is relevant on the point including the danger involved when resolving this issue. And on the issue of what is a reasonable period of time, the plaintiffs have the burden of proof.”
