The trial court stated that “[t]he second issue you must decide is whether the landlord had constructive notice of the violation or if the landlord did not, whether the landlord received actual notice of the violation. The violation would be the existence of lead-based paint in violation of the Federal statute standard, or it would be the presence of cracked, chipped, blistered, flaking, loose or peeling paint, which constitutes a health hazard. As to what would constitute a health hazard, you’ll have to focus on the evidence. I think you’ve had testimony about the condition of the paint and also opinions.
