As originally drafted, subdivision (b) read as follows: “[¶] In an action brought by or against the tenant, the introduction of evidence which shows that an alleged act of retaliation occurred within 180 days after any of the events specified in paragraphs (1) to (6), inclusive, of subdivision (a) creates a rebuttable presumption affecting the burden of producing evidence that the landlord’s conduct was retaliatory. If the evidence introduced shows that the alleged act of retaliation occurred after that 180-day period, the tenant bears the burden of producing evidence that the landlord’s conduct was, in fact, retaliatory. The 180-day period shall commence after the latest occurrence of any of the events specified in paragraphs (1) to (6), inclusive, of subdivision (a).” 9
