"In the event the rent being charged to [a] tenant is determined to be the product of a fraudulent scheme to deregulate the apartment, the default formula is then employed to calculate the rent on the base date. . . . [T]he issue of fraud must be determined before the issue of overcharge can be addressed, as a finding of fraud will necessitate the application of the default method (emphasis added)." (Id. at 4.)
