"[r]ecently enacted New York State legislation modified the evidentiary burden applicable to a tenant alleging an unlawful rent. Instead of establishing the common-law elements of fraud, the legislation provides that . . . the court is required to consider the 'totality of the circumstances' in making its determination (emphasis added)."
