"It is well settled that the sole exception to strict application of the four-year rule [to overcharge claims] is triggered when the tenant proves that the landlord engaged in a 'fraudulent scheme to deregulate' (i.e., a fraudulent scheme to remove the apartment from rent regulation). Regina, 35 NY3d at 354-56; Conason v Megan Holding, LLC, 25 NY3d [*6]1, 16 (2015) (fraud involves 'the setting of an illegal rent in connection with a stratagem devised by [the landlord] to remove tenants' apartment from the protections of rent stabilization . . . .'")
