On December 3, 2007, the matter came to a court trial before the Honorable Suzanne Ramos Bolanos. The testimony and report of housing inspector Claudio Bluer were admitted into evidence. Bluer testified he had inspected the building in February 2007, two years after it had been vacated by the Chacons. According to his report, the apartment exhibited, among other things, mold and mildew in the living room and bedrooms, water damage and rot, no finished floor covering holes in the floor, a “nonconforming and dilapidated” stairway, and “unsanitary conditions” throughout. The report stated that “[sjeveral [code] violations constitute immediate life-threatening hazards, directly affecting health and safety (habitability).”
