Ct. 788 (2009), decided after the district court dismissed the stu- dents’ claims, held, to the contrary, that Title IX does not bar § 1983 suits to enforce rights under the Equal Protection Clause. As in Fitzgerald, the plaintiffs here invoke § 1983 to seek damages for violations of constitutional rights. See id. at 796-97 (explaining distinctions between the rights created by Title IX and those afforded by the Equal Protection Clause).
