493 charsThe district court subsequently dismissed the § 1983 claim as “subsumed” by the Title IX claim, citing Middlesex County Sewer Authority v. National Sea Clammers Ass’n., 453 U.S. 1 (1981). The district court then granted UCD’s motion for summary judgment, holding that the students were required, to perfect their claim, to give UCD notice in advance of filing suit of the alleged Title IX violation and an opportunity to cure it, and had failed to do so. The students timely appealed. ANALYSIS
