HUD argues that regardless of whether section 10.1 would have required notice-and-comment rulemaking in this case, the United States Housing Act, 42 U.S.C. § 1437d(k), sets out specific procedures to be used in making due process determinations, and therefore overrides HUD’s regulation in this particular.
