548 charsThe APA rulemaking requirements do not apply to agency rules “relating to ... public property, loans, grants, benefits, or contracts.” 5 U.S.C. § 558(a)(2). HUD, however, voluntarily, has adopted requirements for notice and comment rulemaking in these situations. See 24 C.F.R. § 10.1. The sole substantive question presented in this appeal is whether, under section 10.1, HUD was required to use notice and comment rulemaking procedures in making its determination that Washington state-court eviction procedures met HUD’s due process standards.
