The Secretary has interpreted the italicized language as giving eligible tenants a “right to remain,” enforceable against owners who would seek to evict them, so long as the tenants pay their portion of the rent as defined in Section 8. Every federal court to consider the question to date has agreed with the Secretary’s construction of 42 U.S.C. § 1437f(t)(1)(B). See Feemster v. BSA Ltd.
