407 charsPetitioners in No. 74-647, the State of New York and the New York State Housing Finance Agency, argue that respondents’ suit against them is barred by the Eleventh Amendment. The Court finds it unnecessary to deal with this contention, but my conclusion requires that I answer the Eleventh Amendment defense. The Court of Appeals found no Eleventh Amendment bar here, and I am in agreement with this result.
