Lastly, Smith v. Ash, Ky., 448 S.W.2d 51 (1969), discusses equitable principles being applied when equity demands. We are of the opinion the equities of this case are with the nonsigning owners of the property. Therefore, our conclusion is that the lease is void as a matter of law, and the trial court erred in concluding otherwise. The declaratory judgment is reversed. LESTER, J., concurs.
