471 charsThe plaintiff first claims that the court improperly rendered summary judgment in favor of the defendants on the first count of her complaint. The court concluded that count one, while pleaded as a cause of action for breach of contract, actually stated a claim of negligence. The court therefore rendered summary judgment because the plaintiff had failed to commence her action for negligence within the applicable statute of limitations period. We agree with the court.
