The Trustees allege that the attics of many condominiums were improperly ventilated, breaching the warranty of habitability and constituting negligence. In 1984 and 1985, as managing trustee, Kaplan went onto the roof and observed that there were no ridge vents. Based on Kaplan’s knowledge, the Board of Trustees had notice of this defect in June of 1984 and the statute of limitations began to run at that time. The plaintiffs’ claims for improper attic ventilation were thus timely filed. 5.Firewalls
