The plaintiff condominium trustees (“the Trustees”) filed this action against the developer of the CotuitBay Condominiums, Stuart Bornstein (“Bornstein”), the original trustees of the unit owners’ association, and the general contractor of the development, Cotuit Bay Condominium, Inc. (“CBC”), alleging numerous construction defects. This matter is before this Court on a remand from the Supreme Judicial Court for trial of negligence and breach of warranty claims which were improperly dismissed. See Berish v.
