315 chars392 Mass. 228, 236 (1984), in which we stated that “[i]t is only where the same acts cause the same injury under more than one theory that duplicative damage recoveries will not be permitted.” Here, the same act caused separate injuries, and, thus, the plaintiff was entitled to recover damages under both statutes.
