The takings clause is intended to provide private citizens with just compensation when the government takes their private property for public use. It most obviously applies to the government confiscation of an individual’s real property, as by eminent domain. Such a “classic” of per se taking includes governmental appropriation of property and the “ ‘ “practical ouster” ’ ” of the owner from the property. (Lingle v. Chevron U.S.A. Inc.
