We affirm the judgment of the Court of Appeal to the extent that it reverses the superior court’s order sustaining the demurrer without leave to amend and reverses the resulting judgment of dismissal, but reverse the Court of Appeal’s judgment to the extent that it directs the superior court to enter a judgment declaring that section 4.56.020(i)(l) is preempted by the litigation *1253privilege. We remand the matter to the Court of Appeal for further proceedings consistent with the views expressed in this opinion.
