*63 Relying upon commercial law cases involving warranties of fitness and merchantability, modern legislation providing that landlords bear primary responsibility for maintaining safe and clean housing, and Hinson v. Delis, supra, 26 Cal. App.3d 62 [102 Cal. Rptr. 661] as well as decisions of other states, we concluded that warranty of habitability is implied by law in residential leases in this state.
