Construed KRS 383.595 (landlord's maintenance obligations) and KRS 383.625 (tenant remedies for noncompliance) to create a non-waivable implied warranty of habitability. Tenants in Louisville and other URLTRA jurisdictions may use the 14-day notice procedure to terminate or repair and deduct; non-URLTRA Kentucky tenants are limited to common-law remedies under KRS 383.010 et seq., which the court acknowledged are materially weaker.
