The trial court specifically found summary judgment in favor of BNSF was proper on the
claim for injurious falsehood because “for a statement to be actionable as injurious falsehood it
must be defamatory.” Others First, Inc. v. Better Bus. Bureau of Greater St. Louis, Inc., 829 F.3d
576, 580 (8" Cir. 2016); see also State Ex Rel. Diehl v. Kintz, 162 $.W.3d 152, 156, n.4 (Mo.
App. E.D. 2005). Thus, because the trial court found the defamation claim was not actionable, it
held the injurious falsehood claim likewise failed according to the law.
