442 charsWe find no actual authority existed as the evidence failed to establish any of the three elements necessary to create an agency relationship. There was no testimony that Purchaser vested Prior Owner with any of its powers, that Purchaser controlled Prior Owner’s actions, or that Prior Owner acted on Purchaser’s behalf as a fiduciary or in any other respect.
