“ Cannot recollect that Judge Krum came to my office with Grumley with the papers, nor can I say that Grumley was present when I got the check from Judge Krum. I cannot say that I took out my fees in any other cases than the one where we had judgment. Grum-ley went, shortly after the settlement, to Memphis, in the beginning of 1865, and wrote to me repeatedly to go on with this $7,000 suit. He spoke to me when he came back here afterward about this $7,000 suit, and it seemed to be his idea that the suit was still pending. I do not recollect ever speaking “I saw the judgment was too large. *******
