478 charsBoth the'materiality of the misrepresentations and plaintiff’s right to 'rely thereon are obvious. ‘ ‘ The misrepresentation of the defendant’s proposed use of the plaintiff’s tenement was a misrepresentation of a material fact.” Kilroy v. Barron, (Mass.) 95 NE 2d 190.
