We likewise reject plaintiffs contention that no warranty of habitability can be implied inasmuch as the house was not “new” when the parties signed the agreement. It is undisputed that plaintiff built the house on land he owned, and that defendant was the first person who contracted to buy the house from plaintiff. The fact that several months elapsed from the time plaintiff built the house until defendant signed the agreement does not, in our opinion, mean that the house ceased to be “new” within the meaning of Old Warson.
