D.C.Code § 42-3405.03b (b) (2008 Supp.), which directs the court to "examin[e] the substance of the transaction” and to consider whether it was a "step transaction ... employed for the purpose of avoiding the obligation to comply with the requirements of this chapter,” was enacted after the transaction at issue took place. The Tenants’ Association acknowledges that the amendment has only prospective force, so it does not apply here. 4
