Testimony from the partners established that Margaret received $925 per month in rent over a period of approximately six (6) years, a total of nearly $67,000. Many of the rental payments were delivered to her personally by the spouses of Wilcox and Clark, and Margaret collected some payments at the premises itself, where she could observe the operation and those individuals involved in it. Further, Gilbreth testified he told Margaret that he was "taking over the lease" and that Miller was leaving. We believe the evidence supports the conclusion that Margaret had "knowledge," whether actual or constructive, of the sublease arrangement entered into by Miller and Gilbreth, and we believe that is all that is required under Setzer's Steel Systems and Venters.
