In the present case, appellees’ claim is against Margaret’s executor and, as such, we do not believe appellees’ claims are subject to the deadlines set out in KRS 396.011(1) and 396.055(1). Further, we do not believe the fact that appellees actually filed a claim against the estate, later denied by Batson, is significant. Based upon the above-cited ease law, appellees’ allegations are not in that class of “claims” which must be filed against the estate prior to bringing suit. Thus, ap-pellees had no obligation to file an initial claim against Margaret’s estate, despite the fact they did.
