706 charsAdditionally, a review of the statutory scheme governing landlord/tenant relations reveals one section which permits a landlord to enforce charges without a court order. Under §34-18-19, a landlord may retain all or a portion of a tenant's security deposit (up to one month's periodic rent) without application to court to recover unpaid, accrued rent and also the amount of physical damages to the premises. The landlord has the discretion to determine the amount of physical damage sustained to the premises. Otherwise, a party alleging a breach of a rental agreement must apply to court for enforcement of his or her contractual rights. Self-help eviction is prohibited. Sections34-18-44 and 34-18.1-15.
