510 charsThis Court finds that the legality of the method of rental increase, the key issue in Baker, is not at issue in the present matter. Rather, the plaintiffs' allegations turn on the defendant's failure to renew the terms of their present leases, which they allege, constitutes reprisal. The uniformity of the methodology, has neither been questioned, nor raised by either party. As a result, the Court need not consider the remaining elements of collateral estoppel because the identity of issues does not exist.
