The owner submitted a reply which the Commissioner has also reviewed.

The PAR is granted in part, and the RA order is herein modified.

Based on the rent ledger in evidence, the 'owner credited $1,942.72 to the tenant on August
17, 2017, which is over three years prior to the filing of the tenant's rent overcha_rge complaint.
Since this money was credited before the rent overch!1rge complaint, it should not be part of the
. rent overcharge. Therefore, the rent overcharge found by the RA should be decreased by said
amount to $1,620.10 ($3,562.82 - $1,942.72).
