1,199 charsThe tenant replied, substantively reiterating contentions made in her PAR, contending that there was a 17 year reg istration gap; that the 2013 registration listed her as a stabilized tenant in contradiction to the owner's claim that the apartment was deregulated in 2006; that, from 2009-2022, the rent remained below $2,000.00 per month contradicting free market behavior and aligning with rent stabilized limits; that in August of 2022 the owner imposed a 30% increase in rent with only 2 PAR Docket No. NP410028RT two-week's notice, claiming over $26,000.00 in back rent, in an attempt to intimidate the tenant; that this prompted the tenant to initiate her investigation; that the 2005 and 2006 rents were suspicious in that they were exact} y $5 .00 over the then deregulation threshold; that the claimed owner occupancy was not documented; and that the coordinated inconsistency and misrepresentation by the owner requires investigation of pre-base date rental events, a finding that the apartment has been fraudulently deregulated, and a finding that the apartment is accordingly still a rent stabi lized apartment. Having carefully reviewed the record, the Commissioner denies this PAR.
