1,780 charsOn PAR, the tenant requests that further action be taken to have the owner discontinue placing incorrect arrears arid attorney fees on the monthly rent statements. The tenant asserts that she has been approved for SCRIE and that her monthly rent payment is $1,170.25. She asserts that her monthly MCR is $ 1,096.22 and that the owner has to refund rent overcharges. PAR Docket No. NP420013RT The PAR is denied. The tenant has not cited.to any error of fact or law committed by the RA in rendering his decision and has not stated any legal basis to modify or revoke the RA order which granted her rent overcharge complaint. The RA set the MCR as $1,096.22 as of May 1, 2013 with no change to the present date. To the extent that the tenant has been paying $1,170.25 or any amount over $1,096.22 since May 1, 2013, the tenant may seek enforcement of overcharges in a court of competent jurisdiction. DHCR does not award overcharges in rent control proceedings. In terms of the billing for arrears and attorney fees, the tenant my file an order to show cause in Court for violation of the stipulation because the Court stated that it retains jurisdiction for any violations of the stipulation. • THEREFORE, in accordance with the provisions of the New York City Rent and Rehabilitation Law and the regulations promulgated thereunder, it is ORDERED, that the petition for administrative review is denied, and that the Rent Administrator's order is affirmed.
