1,049 charsHere, the tenant's complaint was filed on February 14, 2022, invoking a six-year review period under the Housing Stability and Tenant Protection Act (HSTPA) of June 14, 2019. The base date thus was February 14, 2016 and the base date LRR was $1,038.71 per month as per a renewal lease with a prior tenant and a contemporaneous rent registration. On February 1,2019; a tenant prior to the petitioner moved-in on a one-year lease expiring on January 31, 2020 at a rent of$3,000.00 per month. The owner was entitled to a statutory vacancy allowance of 19% plus a statutory longevity increase of 6.6% on the base date rent of $1,038.71. The owner also proved the cost of$73,875.00 in IA!s which netted a rent increase equal to 1140th of this amount or an additional $1,846.88 monthly. The vacancy, longevity and IA! rent increases raised the LRR to $3,151.50 per month which was over the then in effect deregulation threshold thereby legally deregulated the apartment before the passage of HSTPA and before the petitioner took occupancy two years later.
