475 charsJacobs, J. George Rothman, as trustee (the landlord), initiated this proceeding pursuant to the Cambridge Rent Control Act, St. 1976, c. 36, § 9, by applying to the Cambridge Rent Control Board (the board) for a certificate of eviction of Shirley Attanasio (the tenant) for nonpayment of rent. Upon the denial of his application, the landlord appealed to *218the Superior Court, which affirmed the board’s denial. His appeal to this court is from that judgment of affirmance.
