After Solomon’s counsel asked the witness to describe the factors on which he had relied for his conclusions, the trial judge stated that “any statements that the witness testified that he relied upon [are] only being admitted for the purpose of showing the basis of his opinion. ... In other words, it’s simply being admitted to show the information that he had when he formed his opinion. I’m not allowing it to be introduced to show the truth of those facts. The jury will have to make its decision with regard to what facts in the case are true.” In his final instructions to the jury, the judge again emphasized that “ [t]he jury is the sole judge of the credibility of the witnesses.” 9
