In the meantime one P. D. Burtt and P. J. Peykert, defendants herein, were operating a mine on property adjacent to the property of the Mining Company and they became interested in buying that portion of the property of the Mining Company immediately adjoining theirs. Burtt contacted Bichardson and the latter advised him of the plaintiff’s option and informed him of the fact that he, Bichardson, only represented one-half of the stock and that the other half was owned by H. D. B. Soule. Burtt contacted H. D. B. Soule through the latter’s attorney, Edgar T. Zook. H. D. B. Soule through Zook offered to sell his half of the stock for $6,000.
