More relevantly, no state court in this proceeding is being called on to interpret or enforce federal law. All defendants ask is that state law be construed so as not to thwart the express purposes of a remedial federal statute. The supremacy clause of the United States Constitution (U.S. Const., art. VI, cl. 2) commands no less, as was demonstrated by the Supreme Court in Nash v. Florida Industrial Comm’n.
