“Perhaps the prime motive behind the new habitability duty, however, was the public policy concern over the quality of the nation’s housing stock. Dilapidated housing was a public as well as a private concern. Substandard housing created filth that spread to the streets. It bred disease if not crime. It was an eyesore and a public disgrace .... Housing codes attempted to address this problem, but their enforcement was dramatically inadequate.
