(1981) 126 Cal.App.3d 515 [179 Cal.Rptr. 5], the plaintiff’s hand was crushed while operating a punch press which the defendant, a dealer in used machinery, had sold to the plaintiff’s employer. Evidence was introduced that a safety device that was part of the machine when it was built more than 50 years earlier apparently had been removed by a previous owner. Prior to the sale, the defendant had seen the machine in operation and observed that it was in good operating condition. The previous owner had experienced no malfunctions. The defendant sold the machine to the plaintiff’s employer “as is” and, although the defendant’s employees “tried out” the machine prior to delivering it, they made no adjustments or modifications to the machine.
