334 charsAt the outset, the court rejects the petitioner’s argument that the six-year statute of limitations applies to sue respondent, because the behavior alleged amounts to a breach of contract. This proceeding is not brought to remedy a breach of lease, but is predicated upon violation of a statute. Thus, it is not contractual in nature.
