The landlord does not deny the basic facts of each plaintiff's tenancy, but claims that "mistakes were made" in reliance on DHCR guidance. Defendants do not explain how they could have continued to rely on that guidance after the Court of Appeals issued its decision in Roberts in 2009, and the landlord's claim is further called into question by defendant Bogoni's sworn testimony that he became aware, at some time between 2009 and 2011, of his obligation to treat all tenants in the building as rent stabilized.
