347 charsIt is hereby ordered that the order so appealed from is unanimously modified on the law by gránting that part of the motion for partial summary judgment on liability on the claim for breach of contract based on unlawful eviction and by providing that the claim for punitive damages is dismissed and as modified the order is affirmed without costs.
