Plaintiffs filed, simultaneously with their complaint, a motion for a temporary restraining order and preliminary injunction. Hillvale then agreed to forbear any rent increases or eviction proceedings from December 1, 1988, until March 1, 1989, reserving the right to retroactively collect rent increases during that period should it prevail on the merits. By order of February 28, 1989, the district court made the for*1307bearance agreement effective until a hearing on plaintiffs’ motion for preliminary injunction.
