Third, the FHF was hired particularly for its technical competence in the area of fair housing. Fourth, the public would have perceived the FHF as the City’s official fair housing agency. The FHF was also privy to confidential information received from citizens who contacted the organization for counseling and referrals. Because of the FHF’s wide-ranging control over the City’s fair housing program, we do not consider it significant that the organization had limited contact with elected officials or authority over other city agencies.
