Where a plaintiff has from the outset misconceived the law and has chosen a mistaken legal theory to submit to the jury for redress, we may reverse the judgment against the plaintiff and remand the cause to allow the plaintiff to plead and to submit another theory. We do so, however, where the evidence shows the plaintiff may reeover upon another theory. And, we do so because the plaintiffs counsel has missed completely the appropriate theory. Simple fairness requires the plaintiff be given a meaningful day in court.
