. Part of H & M’s claim of prejudice is its alleged surprise at having to defend against events occurring after the filing of the complaint. However, if H & M really had no notice of Fernandez’s intent to introduce such evidence, as it claims, it could not have prepared and filed a motion in limine on this very issue before the trial began. The fact that it did so undermines its assertion of prejudice.
