¶34 Both parties request attorney fees on appeal. Because, however, no party has yet prevailed on the merits, *427such an award is premature. See Home Realty Lynnwood, Inc. v. Walsh, 146 Wn. App. 231, 242, 189 P.3d 253 (2008). ¶35 Reversed and remanded.11 Appelwick and Lau, JJ., concur.
